The photographic data registered on this site was taken and collected by Kanagawa Prefecture for the purpose of introducing and publicizing tourist attractions in the prefecture. Please read the Terms of Use before using this site.
Kanagawa Prefecture (hereinafter referred to as "the Prefecture") grants licenses to those who wish to use the photographic data provided in the "Photo Library" (hereinafter referred to as "the Site") in accordance with the following terms and conditions:
The photographic data registered on the Site was taken and collected by Kanagawa Prefecture for the purpose of introducing and publicizing various tourism sites throughout the prefecture. The data is licensed free of charge to users only when they wish to use it in accordance with this purpose.
Those who wish to obtain a license may apply only if they agree to these Terms of Use.
There are no restrictions for simply viewing the photographic data.
The photographic data is a copyrighted work protected by copyright law and its related international treaties.
The copyright belongs to the Prefecture.
Therefore, except for personal use as permitted by copyright law, the photo data may not be reproduced, duplicated, sold, or loaned without the permission of the copyright holder.
The photographic data is licensed only under the terms and conditions set forth in this Agreement, and the Prefecture retains the copyright and license rights to the photographic data even after license to use the data is granted to the user.
If the user wants to use the photo data, the Prefecture will grant a non-exclusive, non-transferable license to the person who downloads the photo data (hereinafter referred to as the "User") only after agreeing to these Terms and Conditions and applying for the license by specifying the purpose of use of the photo data.
The User is granted a license to use the photo data solely for the purpose of activities that contribute to the promotion of tourism in the Prefecture.
The use of photo data is limited to one application per purpose of use and per use. If you wish to use the photo data for multiple purposes, please submit a new application, even if it is the same photo data.
Even if the purpose of use is to contribute to the promotion of tourism in the prefecture, the following uses and purposes are prohibited:
Manufacture, sale, or distribution of products whose merchantability depends on the image data itself (for-sale postcards, calendars, digital data collections, etc.)
Items intended solely for religious use
Material that is clearly offensive to public order and morals
Items that may lead to criminal acts or encourage criminal acts
Items that may infringe on the copyrights or other intellectual property rights of the Prefecture or other third parties through their use
Items that may infringe on the rights, property, privacy, etc. of third parties or others through their use
Items that are used for the purpose of defaming or slandering a third party, etc.
Use for pre-election campaigning, election campaigning, or similar activities as defined in the Public Office Election Law, or use for the production of printed materials for such activities
Any other use that significantly deviates from the original intent of the photo data
The following acts are prohibited in the use of photo data:
Editing (cropping, changing aspect ratios, compositing, etc.), except for enlarging or reducing the size of the image
Providing photo data for secondary use without using the data itself
Transferring or lending the photo data to a third party, whether with or without compensation
Processing or use that damages or may damage the image of the photo data or the subject
Use for the purpose of supporting, recommending, slandering, or defaming the activities of a specific individual, group, or organization, or use that may be misunderstood as such
The obligations and responsibilities of the Prefecture and the User with respect to the use of the photo data are as follows:
The use of the photo data is the sole responsibility and obligation of the User
The person, item, or place that is the subject of the photo may have portrait rights, trademark rights, copyrights, patent rights, usage rights, or other rights, and it is the duty and responsibility of the User to take care of these rights when necessary
In the event that any damage, disadvantage, or dispute with a third party arises as a result of the use of photo data, the Prefecture will not be involved in or be held responsible for any damage, disadvantage, or dispute
The photographic data contained in this site is current as of the time the photos were taken, and the Prefecture does not guarantee the accuracy, usefulness, or completeness of the photographic data, at present or in the future
The Prefecture will not be liable for any disadvantage or damage to users or other third parties resulting from the use of the photographic data, unless such disadvantage or damage is caused by the Prefecture's willful misconduct or gross negligence
